According to the lawsuit, the parents believe the board violated their rights by preventing them from raising issues about a student who reportedly had connections to the MS-13 gang and was allowed to return to school. The student, who is allegedly in the country illegally, had previously been arrested for carrying a firearm and threatening another student.
America First Legal, an organization representing the parents, argues that the school board’s actions exemplify a disregard for the First Amendment rights of concerned community members. Ian Prior, Senior Advisor to America First Legal, stated, “This latest constitutional violation is even more pronounced, given that the topic was related to the safety of students.” The case is currently being heard in the U.S. District Court for the Eastern District of Virginia, with the parents claiming that their First Amendment rights were obstructed at the October 8 school board meeting, where microphones were reportedly cut, and the public comment period was abruptly ended.

In response to the controversy, the Loudoun County School Board issued a press release, defending their decision to cut the public comment period. . According to the board, the parents were attempting to discuss “unverified allegations” about the student in question, despite repeated warnings from the Board Chair. The board claims that their actions aimed to “restore order” and prevent the spread of what they characterized as “misinformation.”
The board’s statement emphasized the need for vigilance against unverified claims that could create division within the community. “Misinformation is on the rise, and school divisions like LCPS must be vigilant in actively combating it,” the release said. They further argued that making allegations against the student without concrete evidence is both inappropriate and unfair to all parties involved, asserting that the board must protect the privacy and safety of individual students while maintaining community trust.
